Terms of Service

These Terms govern access to PageSense at rag.esap.ai, operated by Empowering Energy (trading as ESAP AI) (CR No. [Insert CR Number]). They apply to the Client organization and all Authorized Users. They operate alongside MSA, SOW, and DPA — MSA/DPA takes precedence in conflicts.

• Secure document upload and ingestion (PDF, JPG, PNG).
• Multi-engine OCR text extraction (Classic PaddleOCR, Qwen VL 2B/9B, DeepSeek, Chandra).
• Bilingual Arabic and English document processing and query support.
• BGE-M3 vector embedding generation with dual vector database backends (Qdrant and PGVector).
• Page-level document chunking and intelligent segmentation.
• AI-powered grounded question-answering with page-level citations and source references.
• Hybrid retrieval using Reciprocal Rank Fusion (RRF), combining semantic and keyword search.
• Answer Workspace for inspecting, comparing sources, and reviewing evidence.
• Admin pipeline control for OCR engine, embedding model, vector DB, and preprocessing configuration.
• Client Admin portal with fixed enterprise presets for document upload and processing.
• Client Main chat interface with suggested prompts for end users.
• Document management with status tracking, reprocessing, and deletion.
• Developer Mode with full workspace visibility for technical administration.

Access is granted exclusively to the Client and designated Authorized Users per signed MSA. The platform provides three access levels:

Admin

Full pipeline control and configuration.

Client Admin

Document upload and processing with enterprise presets.

Client Main

Document querying and chat interface only.

The Client is responsible for credentials, assigning appropriate access levels, and ensuring all users comply with these Terms.

The Client bears full responsibility for:

• Ensuring all uploaded documents are lawfully held and authorized for AI processing.
• Classifying documents by sensitivity before upload (Public, Internal, Confidential, Restricted).
• Ensuring personal data within documents is processed under a valid lawful basis under PDPL.
• Informing relevant Data Subjects where required by PDPL.

PageSense does not pre-screen or classify uploaded documents. Empowering Energy (trading as ESAP AI) is not liable for the Client's upload of documents containing personal data without a valid lawful basis.

Prohibited:

• Uploading documents that the Client does not have the lawful authority to process.
• Using the platform for personal, non-business purposes.
• Reverse engineering the platform, OCR engines, embedding models, or retrieval algorithms.
• Using outputs or citations to develop competing products.
• Sharing or reselling access.
• Using AI-generated answers as the sole basis for legal, financial, or regulatory decisions without human verification against source documents.

• OCR extraction accuracy varies by document quality, scan resolution, and language complexity.
• AI-generated answers may contain errors, omissions, or incomplete citations.
• Page-level citations are provided for verification — users must review original source documents before relying on answers.
• All outputs are labeled: “AI-generated — verify against source documents before formal use.”
• Empowering Energy (trading as ESAP AI) is not liable for decisions made based on AI-generated answers without human review of cited sources.

The Client retains full ownership of all uploaded documents, extracted text, embeddings, queries, answers, and related content. Empowering Energy (trading as ESAP AI) commits to:

• Never selling, licensing, or sharing Client Content.
• Never using Client Content to train AI models without explicit written consent.
• Accessing Client Content only for contracted service delivery, security, or legal compliance.

Governed by the Privacy Policy and signed DPA. Complies with PDPL Royal Decree M/19 of 2021 and its Implementing Regulations.

Defined exclusively in a signed MSA or SOW. These Terms do not govern billing independently.

Intellectual property is exclusive to Empowering Energy and includes platform software, OCR pipelines, embedding algorithms, retrieval systems, branding, and documentation. Confidentiality obligations survive for three years post-termination. Service availability targets 99.5%. Liability is capped at three months of fees. On termination, a 30-day data export window covers original documents, extracted text, and query logs. Governing law is KSA (courts in Riyadh). Changes to these Terms take effect after 14 days' notice.
